Austin Foam Plastics Expansion

As some of you all know I was not able to attend the planning and zoning meeting held on the 20th due to a death in the family. I therefore have no idea what the outcome of the meeting was. I have emailed the city requesting this information and as soon as I get it I will share it with you all. As for a final decision the city counsel will make that at a later date. Its not too late to stop AFP from being rezoned and I plan to attend the city counsel meeting to do my part to stop them. This morning the Planning Department met with our GIS Department to verify your petition. It appears that the petition does not meet the 20% of affected property owners as we first thought last night. I have attached a copy of the map of the surrounding property.

State Law Provides:

The protest must be written and signed by the owners of at least 20 percent of either:

(1) the area of the lots or land covered by the proposed change; or

(2) the area of the lots or land immediately adjoining the area covered by the proposed change and extending 200 feet from that area.

The commission will most likely reconsider this matter again at their October 20th meeting. In addition to the State requirements that we notify all property owners within 200 feet the City also notifies all property owners within 500 feet and the affected Home Owners Association. Since we have already notified these property owners the City will not re-notify the area. You may submit additional petitions in order to protest this application and require the City Council to have 3/4ths of its members vote to approve the zoning change if you so desire. The staff would request that any additional petitions be filed at the City Planning Office at least 24 hours before a meeting so that we may verify the petition.

I then called and spoke with Floyd on the phone. He told me that without approximately 12% more signatures this request will go back to the commission on Oct 20th and only require regular majority to pass. I need your help in getting those signatures. Talk to your neighbors especially if they live on the west side of Grafton lane. It appears that the city does not care that the rest of you are opposed to this change.

As those of you in the affected area know Austin Foam Plastics Inc. the company located at 2933 A.G. Grimes has recently submitted a request to the City Of Pflugerville to having their business rezoned from Agriculture/Conservation to Light Industrial. The company did so because they want to increase the building (size) at this location by 40000 sq ft. and in doing so consolidate two locations that are currently in Austin to this Pflugerville location.

When I spoke with most of you in the "500' notification" area, I explained the potential negative affects this would bring to our community and specifically the increase in semi-truck traffic/noise to the area directly affecting our property values in some way. On 10/06/2008 the planning and zoning commission of the City of Pflugerville held a public hearing which I attended. I am pleased to say that as a result of getting 65 signatures on the petition to block the change the city has tabled the issue and agreed to rehear the issue in November. The city was forced to wait to vote on the issue because as a result of having more then 20% of the residence in the affected area sign the petition they had to vote "super majority" (6 out of 7) as opposed to majority (which is need to pass most changes).

As some would say this was a victory for us as home owners. Unfortunately this problem has not gone away completely. As stated above the commission will hear this request again in another public meeting in November. I plan to attend the meeting and again request that the commission refuse the request for the change. I also plan to get a lot more organized in my efforts and will be be requesting that any interested parties make contact with me tough the forum.

Thanks to all those who signed the petition and helped to block the first request. I'll be in touch in the coming weeks and welcome any suggestions to help in the blocking of this request for good.

Pruning Information from Pflugerville’s Forester

It is that time of year; many people are out sprucing up their yards and getting ready for spring. I would like to share some timely pruning information. Firstly, we have entered the time of year when oaks that are susceptible to the oak wilt fungus should not be pruned. While we do not have an infestation here in Pflugerville, oak wilt centers exist in communities all around us including Round Rock, Austin, and Georgetown. What trees are susceptible to oak wilt? Spanish oak (red oak), Shumard oak and live oak are the most likely to be infected. It is best to prune these trees in late fall or winter. If you must prune to clear a low limb or clean up a broken limb, apply a pruning paint immediately over the wound. The paint will mask the ‘smell’ that attracts the nitidulid beetle which carries the oak wilt fungus. Thick pruning sealers are not recommended because they may trap moisture in a pruning wound.
Secondly, crape myrtles do not need to be topped to produce an abundance of flowers. Topping is the practice of cutting limbs back leaving a stub, instead of cutting back to a branch union and preserving the branch collar. It is not a recommended practice by the International Society of Arboriculture. While crape myrtles are very tolerant to its effects, larger trees often become hazardous from such practices. Even if your crape myrtle is under a powerline, such severe pruning is not recommended. Instead, ‘directional pruning’ is recommended to clear the limbs away from the lines. Drop by Drop Landscape Rebate Programs

The Drop by Drop Landscape Rebate Programs in now effect. The City of Pflugerville feels a responsibility in actively promoting sound water use and conservation. To promote this philosophy, the Drop by Drop Rebate program was created. Residential customers of the City water utilities are eligible to participant in this program. Purchasing and installing plants on the Drop by Drop landscaping list will qualify for a rebate check of a minimum of $50. to $500.00 ONLY PLANTS on the list and planted after the submittal of Application One will be eligible to submit for the rebate.   Applications are available online, at the Parks and Rcreation Department and City Hall. New Water Softener Replacement Rebate

The City of Pflugerville is now offering a Water Softener Replacement Rebate Program to all residential customers that reside in the City’s wastewater service area and are currently utilizing City of Pflugerville wastewater services. Through the rebate program, the City will provide incentives for customers to replace their working timer-based self regenerating water softener with a demand-initiated regeneration (DIR) water softener. The rebate program offers customers $200.00 for the replacement of their water softener. Applicants must purchase a new demand-initiated regeneration water softener, complete and sign a Rebate Application Form and submit it with copies of their sales receipt and UPC sticker. Water Release from Manville Water Tower

In connection to Michael Starr's recent issues with water released from the water tower in our subdivision, we wanted to post some information if anyone else was experiencing problems due to flooding from this issue. The City of Pflugerville said that they and Manville were aware of the overflow from the tank recently. Pflugerville doesnt maintain the Manville system on Madden. Manville was working on resolving the issue. Pflugerville just buys water from Manville. The problem is due to a computer glitch that happens very infrequently which causes the pump to run even though there is enough water in the tank. Because the pump runs too much the excess water runs out and into yards and other areas. The overflow is not from preventative maintenance activities and is an unintentional problem. Please call Manville directly at either 512-84-2035 r 512-856-2181 when this occurs

October Violations!

The Board asked that I report the number of violations we had in SBG in October. It is a fair number.

  • 62 total violations

  • 48 related to yard maintenance

  • 14 related to vehicles, debris, and property maintenance
Please remember to keep your yard trimmed, flower beds weed free and vehicles off the street. And if you've seen Over The Hedge, you should be happy we don't have that woman running our community :)

Also, the next board meeting is Nov 14th, not the 21st.

Recent changes to Pflugervill Pkwy West

Here are some updates. Nothing really exciting right now. The constant rain this summer is really slowing Keystone down.

-Keystone Construction is moving along on the Manville relocations along Pflugerville Pkwy, but their progress has been slow due to the rain. We met with them last week and they intend to be completed at the end of August. I know they have been in contact with your landscaping/irrigation person at TruGreen.

-The City's design consultant has the design completed to about 90% for the Schultz Lane relocation. The land acquisition for the relocated Schultz Lane is also underway. We intend to bid this construction out ASAP. Our hold-up will likely be the ROW acquisition.

-Right-of-way acquisition is moving along well on Pflugerville Pkwy West at this time so we hope to have Pflugerville Pkwy. West bid out in late 2007. Plans are basically complete. I still don't have any construction phasing info yet.

Recent changes to Pflugerville Ordinances that will affect you.


The following ordinances were passed in Pflugerville and could affect you and your property. In summary:

"Enforcement" revises all ordinances to be enforceable by the police department.
"Junk" maybe a useful ordinance to address the stinky barn behind Madden, AND cars that are on blocks in drive ways.
"Parking" Addresses RVs, trailers and boats.

Pflugerville Pkwy West Utility Relocations

Paul,

I have not talked to you in awhile so I wanted to provide you an update on Pflugerville Pkwy West.

-Keystone Construction will start relocating some Manville water lines on Monday the 14th. Here is a PDF sheetof a map that highlights the area in which the water line work will occur. The relocation work will start west of Regis Drive and go to Schultz Lane, then up Schultz to the Austin Foam Plastics site. With this new line work, Springbrook Glen will have increased water pressure. I know there have been a lot of low water pressure complaints from your subdivision. We have stressed to Keystone that avoiding damage to the HOA landscaping is very important, please don't panic if you see some areas they have to cut through we will be working with them to make sure all areas are put back the way they found them.

-The City's design consultant is working on the design of the Schultz Lane relocation. We should be ready to start construction on that relocation this fall.

-Right-of-way acquisition is moving along well on Pflugerville Pkwy West at this time so we still hope to have the roadway project bid out in late 2007. Plans are at about 95%. I still don't have any construction phasing info yet it will probably be a few months before we get to that point.

Pflugerville Pkwy West

I have a few items ready for you and your HOA Board. Here is a PDF sheet that Gary Gemar with HDR created that shows each lot that backs to Pflugerville Pkwy and the distance from the back of curb and the back of sidewalk. You can place this PDF file on your HOA web site if you wish.

The Schultz Lane reroute agreement is still in process between the City and the landowner. When I hear anything new on that I will send you an update email.

Our Environmental Consultant, Dean Tesmer, is preparing something regarding the noise modeling process etc. I still don't have that yet but when I receive it I will email it to you.

Joe Carpenter and I did speak with City Manager, David Buesing, about the City replacing or moving damaged trees in the ROW at the City's cost for Springbrook Glen. Mr. Buesing said for you to put Springbrook Glen's requests in writing and submit a letter to him. It is up to you if you want to mail the letter directly to him or you can send it to me and I will forward it to him.

Sexually Oriented Business(SOB) thwarted

"I'm sending you this email because you sent me correspondence related to a proposed sexually oriented business (SOB) near Pflugerville. This is located in Precinct Two, the area that I represent.

At 5:30 PM Feb 15th 2006, the applicant called me to say that he was withdrawing from the real estate deal on Grand Avenue and would not proceed to closing on the property later this week. He ordered the release of the earnest money to the sellers that he posted on the property.

In early January, I wrote the applicant to urge him to re-think his plans for this site. As a Commissioner, I told him that I would support those who opposed him in pursuing whatever legal avenues were still open to them to prevent the establishment of an SOB at that location.

Since that time, I have been in direct communication with the applicant and his representative to explore whether he would consider a change of plans. He did just that. Tonight's call confirms the real estate deal is off. I thanked the applicant for making this decision and that I felt that it was the best outcome for all involved.

Thanks to all who provided input into this matter. I especially want to thank District 50 State Representative Mark Strama, who also weighed in early in support of the surrounding neighbors on this matter.

Proposed Changes to Pflugerville Loop

Pflugerville is preparing to widen and extend Pflugerville Loop as they have done to Grand Ave Parkway. The proposed changes are here . Because that page takes forever to load, I have copied and pasted below.

City Capital Improvement Project Funded by STP 4C Funds and the 2002 Certificates of Obligation Design Engineer: HDR Engineering, Inc., Austin, Texas

East Pflugerville Loop

The East Pflugerville Loop phase will extend the existing Pflugerville Loop from Railroad Avenue east to FM 685 at Pfluger Lane. The new section will be four lane divided with medians and turn lanes. A hike and bike trail will be constructed on the north side of this section. A traffic signal will be installed at the new intersection of Pflugerville Loop and Railroad Avenue. The Bid Opening for this phase is October 13, 2005, at 2:00 P.M. This phase is funded by the City of Pflugerville. The current cost estimate for this section is $3,700,000.

West Pflugerville Loop The West Pflugerville Loop phase will extend west from Railroad Avenue to Greenlawn Boulevard in Round Rock. The phase is funded by STP 4C funds and the City of Pflugerville and is administered by TxDOT.

This phase will begin at Greenlawn Boulevard and extend east to the new Pflugerville Loop/Railroad Avenue intersection. The typical section of the road will consist of two twelve foot lanes in each direction and a raised median. There will also be a 10 foot hike and bike trail along the north side and a 6 foot sidewalk along the south side of the new roadway. This project is funded by STP 4C (Federal Funds) funds that are administered by TxDOT and City of Pflugerville funds. The project cost is approximately $10 million. Due to funding constraints with the STP 4C funds, the earliest funding will be available in the middle of 2006. Once the funding is available this project will be bid and construction can begin. Proposed Changes to Schultz

There is a proposal with the city of Pflugerville to make some significant changes to Shultz Lane that will have an effect on our neighborhood. I personally have some concerns, as I feel some of the residents may also have, that it will increase traffic thought the neighborhood.

The plan is to get a more active with the city council and the city planers to find a workable solution that will prevent any increases in traffic after the Shultz is changed.

Here is a picture showing a preliminary proposal to the city for approval for the proposed changes.
